Terms of sale
These Terms of Sale govern the contractual relationship between CBS SARL, operator of Domaines Privilège (the “Lessor”), and any client wishing to enter into a domain name lease (the “Lessee”).
Article 1 — Purpose
These Terms define the conditions under which the Lessor makes a domain name (the “Domain”) available to the Lessee for a fixed term, in return for remuneration set out in the special conditions of the contract.
Article 2 — Acceptance
Any lease subscription implies full acceptance of these Terms by the Lessee. The Lessor may amend these Terms at any time; the applicable terms are those in force on the date the contract is signed.
Article 3 — Description of the service
The Lessor grants the Lessee exclusive sectoral use of the Domain, including: DNS delegation to the Lessee’s infrastructure, technical management of the annual registry renewal, and technical support for configuration questions.
Article 4 — Term and renewal
The minimum commitment is 12 months from the Domain going live. At the end of that period, the contract renews tacitly for successive 12-month periods, unless either party terminates with 90 days’ notice.
Article 5 — Pricing and payment
The Lessor’s remuneration is billed per click under the contract terms; amount and methods are set in the special conditions. Payment is by direct debit or bank transfer. Payment more than 30 days late may lead to suspension of the Domain after a formal notice remains unanswered.
Article 6 — Sectoral exclusivity
The Lessor guarantees the Lessee exclusive use of the Domain for the business sector defined in the special conditions. No other Lessee may operate the Domain at the same time.
Article 7 — Purchase option
Subject to mention in the special conditions, the Lessee may benefit from a purchase option on the Domain. Price and conditions for exercising that option are set in the contract.
Article 8 — Lessee obligations
The Lessee undertakes to: operate the Domain in accordance with applicable laws and regulations, not harm the Domain’s brand image, and not use it for illegal, defamatory, abusive or immoral content.
Article 9 — Termination
In the event of a serious breach by either party, the other may terminate the contract as of right after a formal notice remains without effect for 30 days.
Article 10 — Personal data
Processing of the Lessee’s personal data is governed by the site’s Privacy policy.
Article 11 — Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of Paris, after an attempt at amicable resolution.
